Terms of Service

1. Agreement to Terms

By accessing or using MainStreet RevOps ("MainStreet," "we," "our," or "us") — including our platform, website, embeddable widgets, APIs, or any related services — you ("Client," "you," or "your") agree to these Terms of Service. If you do not agree, do not use our services.

MainStreet RevOps is a multi-channel lead intake and marketing automation platform built for home-service contractors.

2. Description of Services

MainStreet provides software-as-a-service including:

  • Multi-channel lead capture (inbound calls, SMS, web forms, AI chat, email, social DMs, field rep text-in)
  • Automated lead response, deduplication, and conversation threading
  • CRM integration and sync (AccuLynx, HubSpot, and others)
  • AI-powered voicemail transcription and field lead extraction
  • Marketing automation including Google Business Profile post drafting, review request delivery, and AI-generated review response drafts
  • Contractor dashboard for lead management, reporting, and marketing approval
  • Embeddable web widgets (forms, chat) served via embed.js

Specific features available to each Client depend on their subscription plan.

3. Subscription and Payment Terms

  • Services are billed monthly in advance per the plan selected at signup
  • Current plans: Starter ($299/mo), Pro ($599/mo), Marketing Add-On ($500/mo)
  • One-time implementation fee ($500) may apply
  • All fees are non-refundable unless explicitly stated otherwise in a separate agreement
  • Late or failed payments may result in service suspension
  • Prices may change with 30 days written notice
  • Free trials, if offered, convert to paid subscriptions at the end of the trial period unless cancelled

4. Client Responsibilities

You agree to:

  • Provide accurate business information during onboarding and keep it current
  • Grant necessary access to third-party systems (CRM, phone numbers, GBP) required for service delivery
  • Comply with all applicable laws including TCPA, CAN-SPAM, and carrier SMS regulations
  • Ensure your use of MainStreet-sent communications (SMS, email) complies with applicable opt-in and consent requirements for your customers
  • Not use the platform to send spam, harass individuals, or violate any applicable law
  • Maintain the confidentiality of your dashboard credentials

5. Communications and Consent

MainStreet sends automated communications on your behalf to your leads and customers — including SMS text-backs, email confirmations, and review requests. By using MainStreet:

  • You represent that you have appropriate consent from your customers to receive these communications
  • You are responsible for compliance with TCPA and applicable state laws governing automated messaging
  • MainStreet provides opt-out handling (STOP/HELP) and honors opt-outs on your behalf, but you remain the sender of record
  • You consent to receive service-related communications from MainStreet via email, SMS, and phone

6. Data and Privacy

  • You retain ownership of your business data and your customers' information
  • MainStreet processes your data solely to deliver and improve the services
  • Lead data, call recordings, voicemail transcriptions, and CRM sync data are stored securely and accessible only to you and MainStreet for service delivery
  • AI features (voicemail transcription, field lead extraction, review response drafts) process data using third-party AI providers (currently OpenAI). Customer PII is filtered before transmission where technically feasible
  • We do not sell your data or your customers' data to third parties
  • Data retention follows the settings configured in your account (default 90 days for media files)

7. Intellectual Property

MainStreet retains ownership of the platform, embed.js, APIs, AI models, and all proprietary technology. You receive a limited, non-exclusive license to use the platform for your business operations during your subscription.

You retain ownership of your business data, customer information, and any content you create or approve through the platform (including approved GBP posts and review responses).

8. Third-Party Services

MainStreet integrates with third-party services including Twilio (voice/SMS), Resend (email), OpenAI (AI features), Ayrshare (GBP publishing), AccuLynx, HubSpot, and others. Your use of these integrations is also subject to those providers' terms. MainStreet is not liable for third-party service outages, pricing changes, or API modifications that affect platform functionality.

9. Warranties and Disclaimers

Services are provided "as is." MainStreet makes no guarantees of specific lead volumes, revenue outcomes, CRM sync success rates, or AI output accuracy. We strive for reliability and maintain production-grade infrastructure but do not guarantee 100% uptime.

AI-generated content (review responses, GBP post drafts, voicemail summaries) requires contractor review and approval before use. You are responsible for the accuracy and appropriateness of any content published on your behalf.

10. Limitation of Liability

To the maximum extent permitted by law, MainStreet's total liability for any claim arising from or related to services shall not exceed the total amount paid by Client in the 3 months preceding the claim.

MainStreet shall not be liable for indirect, incidental, special, consequential, or punitive damages including lost profits, lost leads, or lost revenue.

11. Termination

Either party may terminate the subscription with 30 days written notice. You may cancel anytime through your account or by contacting support — cancellation takes effect at the end of the current billing period.

MainStreet may suspend or terminate services immediately for non-payment, material breach of these Terms, or use of the platform in violation of applicable law.

Upon termination, your data is retained for 30 days then deleted, unless you request earlier deletion or export.

12. Governing Law

These Terms are governed by the laws of North Carolina, United States. Any disputes shall be resolved in the courts of Wake County, North Carolina.

13. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email at least 14 days before taking effect. Continued use of services after the effective date constitutes acceptance.
