1. Agreement to Terms

By accessing and using MainStreet RevOps ("we," "our," or "us") services, website, or submitting any forms, you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

MainStreet RevOps provides sales automation, lead management, and revenue optimization services specifically for home service contractors including roofing, HVAC, landscaping, and related trades.

2. Description of Services

Our services include but are not limited to:

  • Lead loss assessments and revenue analysis
  • Sales process automation implementation
  • Lead response and follow-up system setup
  • CRM integration and optimization
  • Performance monitoring and reporting
  • Ongoing consultation and support services

Specific service details, timelines, and deliverables will be outlined in separate service agreements or statements of work.

3. Payment Terms

  • Assessment services may be provided at no charge as specified
  • Implementation services require payment as outlined in service agreements
  • Care Plan subscriptions are billed monthly in advance
  • All fees are non-refundable unless explicitly stated otherwise
  • Late payments may result in service suspension
  • Prices are subject to change with 30 days written notice

4. Client Responsibilities

You agree to:

  • Provide accurate and complete information for assessments and implementations
  • Grant necessary access to systems, accounts, and data as required
  • Cooperate with implementation timelines and processes
  • Maintain the confidentiality of any login credentials or access information provided
  • Use services in compliance with applicable laws and regulations
  • Not interfere with or disrupt our services or systems

5. Communications and Consent

By using our services or submitting forms on our website, you consent to receive communications from us via:

  • Email messages related to your services, assessments, and account
  • Text messages for appointment scheduling, updates, and service notifications
  • Phone calls for consultation, support, and service delivery

You may opt out of non-essential communications at any time by replying STOP to text messages or using unsubscribe links in emails. Essential service communications may continue as needed for service delivery.

6. Data and Privacy

We collect and use information as described in our Privacy Policy. By using our services, you agree to our data practices. Key points include:

  • We collect business information necessary to provide services
  • Client data is used solely for service delivery and improvement
  • We implement reasonable security measures to protect your information
  • We do not sell or share client data with third parties except as necessary for service delivery
  • You retain ownership of your business data and customer information

7. Intellectual Property

MainStreet RevOps retains ownership of all proprietary methods, processes, software, and materials developed or used in providing services. Clients receive a limited license to use delivered materials for their business operations.

Clients retain ownership of their business data, customer information, and any pre-existing intellectual property.

8. Warranties and Disclaimers

We provide services "as is" and make no warranties beyond those explicitly stated in service agreements. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

While we strive for accuracy in assessments and implementations, results may vary based on numerous factors outside our control. We do not guarantee specific revenue increases or business outcomes.

9. Limitation of Liability

To the maximum extent permitted by law, MainStreet RevOps' total liability for any claims arising from or related to services shall not exceed the total amount paid by Client in the 12 months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or revenue.

10. Termination

Either party may terminate ongoing services with 30 days written notice. Termination does not affect completed services or outstanding payment obligations.

We reserve the right to suspend or terminate services immediately for non-payment, breach of terms, or misuse of services.

11. Governing Law

These Terms are governed by the laws of North Carolina, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of North Carolina.

12. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or website notice. Continued use of services after changes constitutes acceptance of updated Terms.
